Emilie Is A Coach · Policies
Online Coaching Terms & Conditions
1. Agreement and Acceptance
These Online Coaching Terms & Conditions (“Terms”) apply to coaching services provided by Emilie Beck Olsen (“Coach”) through Olsen Digital Media Limited (“Company”, “we”, “us” or “our”).
The person booking or receiving coaching services is referred to as the “Client”, “you” or “your”.
By booking, paying for or participating in a coaching session, the Client confirms that they have read, understood and agreed to these Terms.
If the Client does not agree to these Terms, the Client must not book or participate in coaching services.
The Client must be an adult with legal capacity to enter into this agreement. The coaching service is provided to the adult Client and is not provided directly to children or young people unless expressly agreed otherwise in writing.
2. Nature of Coaching
Coaching is a collaborative process intended to support reflection, awareness, goal-setting, decision-making and personal development.
The coaching service is intended for adults who parent, care for, support, teach, supervise or work with children and young people.
Depending on the Client's circumstances and role, coaching may include discussion of subjects such as:
- Relationships and interactions with children or young people;
- Communication;
- Parenting and family relationships;
- Caring for or supporting children;
- Working professionally with children;
- Boundaries and expectations;
- Behaviour and challenging situations;
- Family, educational or care environments;
- Stress and emotional responses;
- Personal wellbeing;
- Professional or personal relationships;
- Habits and patterns of interaction;
- Life transitions;
- Decision-making;
- Personal or professional development; and
Other areas agreed between the Coach and Client.
Coaching may involve questions, observations, exercises, educational information, perspectives and suggestions intended to help the Client consider their circumstances and possible actions.
The Client remains responsible for deciding whether and how to use anything discussed during coaching.
3. Coaching Is Not Therapy or Regulated Professional Treatment
The Client understands and agrees that coaching is not:
- Psychotherapy;
- Psychological treatment;
- Counselling or clinical mental-health treatment;
- Psychiatric care;
- Medical care or medical advice;
- Diagnosis or treatment of a mental-health condition;
- Diagnosis or treatment of a developmental condition;
- Nutritional or eating-disorder treatment;
- Legal advice;
- Family-law advice;
- Crisis intervention;
- Child-protection assessment;
- Custody evaluation;
- Parenting-capacity assessment;
- Educational or developmental assessment;
- A formal assessment of a child, family, employee, colleague or organisation; or
Any other regulated professional service unless expressly stated otherwise in a separate written agreement.
The Coach does not diagnose, treat, cure or prevent medical conditions, psychological conditions, psychiatric conditions, developmental disorders, eating disorders or other health conditions.
Coaching is not a substitute for appropriate assistance from a doctor, psychologist, psychiatrist, therapist, counsellor, lawyer, social worker, educational specialist or other suitably qualified professional.
The Client is responsible for obtaining appropriate professional advice, assessment or treatment when needed.
4. The Adult Client Is the Client — Not the Child
Unless expressly agreed otherwise in a separate written agreement, the adult who books and receives the coaching service is the sole Client.
A child or young person discussed during coaching is not a client of the Coach.
This applies whether the Client is a:
- Parent;
- Guardian;
- Family member;
- Caregiver;
- Teacher;
- Educator;
- Childcare professional;
- Nanny;
- Coach;
- Youth worker;
- Professional working with children; or
Other adult who cares for, supports, supervises, teaches or works with children or young people.
The Coach does not assess, diagnose, evaluate, treat or provide regulated professional services to any child or young person discussed during coaching.
Unless specifically stated otherwise, the Coach does not independently observe, interview or communicate with the child or young person.
The Coach's understanding of a situation is therefore based primarily on information provided by the Client.
Any questions, observations, suggestions, perspectives or coaching discussions must not be interpreted as a professional assessment, diagnosis or formal conclusion concerning a child or young person.
The Client acknowledges that the Coach ordinarily hears the Client's perspective and that the child, family members, colleagues, professionals or other people involved may have different perspectives or additional information.
5. Client Responsibility for Decisions and Actions
The Client remains solely responsible for their own decisions, behaviour, actions and interactions with children, young people and other persons.
Nothing communicated during coaching constitutes an instruction requiring the Client to act, parent, teach, discipline, supervise, manage, educate, care for or interact with a child or young person in a particular way.
Before acting upon anything discussed during coaching, the Client is responsible for considering all relevant circumstances, which may include:
- The child's or young person's age and development;
- Individual needs and circumstances;
- Physical and emotional wellbeing;
- Safety;
- Professional responsibilities;
- Workplace, school or organisational policies;
- Existing medical, psychological, educational or professional advice;
- Safeguarding responsibilities;
- Legal responsibilities; and
Any other relevant circumstances.
The Client may accept, reject, modify or choose not to act upon any idea, perspective, exercise or suggestion arising from coaching.
Where the Client works with children in a professional capacity, the Client remains responsible for complying with the policies, professional standards, safeguarding procedures and legal duties that apply to their role.
6. Children, Young People and Other Third Parties
Coaching may involve discussion of children, young people, parents, guardians, partners, family members, colleagues, students, teachers, employers, healthcare professionals or other individuals who are not parties to the coaching relationship.
The Client agrees to provide information honestly and fairly to the best of their knowledge.
The Client should avoid sharing unnecessary identifying, medical or otherwise sensitive information concerning a child, young person or other third party.
The Coach cannot independently verify the completeness or accuracy of information provided about someone who is not participating in the coaching relationship.
7. Legal, Custody, Employment and Professional Proceedings
The coaching service is not a forensic, legal, custody, employment, disciplinary or child-welfare assessment service.
The Coach does not, as part of the ordinary coaching service:
- Determine which parent should have custody or residence of a child;
- Determine contact or visitation arrangements;
- Assess whether someone is a fit or unfit parent;
- Conduct parenting-capacity assessments;
- Conduct forensic psychological evaluations;
- Determine whether a teacher, caregiver or other professional is professionally competent;
- Conduct employee-performance or disciplinary assessments;
- Conduct formal educational or developmental assessments;
- Provide family-law or employment-law advice;
- Make recommendations to courts, employers, schools or authorities regarding legal rights, custody, professional suitability or disciplinary matters; or
Act as an expert witness.
The Client must not represent statements, observations or coaching discussions as expert opinions, clinical conclusions or formal professional assessments concerning the Client, a child, another parent, colleague, employee, professional or other person.
The Coach does not agree to prepare reports, recommendations or statements for litigation, custody proceedings, employment disputes, disciplinary proceedings or similar matters unless separately agreed in writing.
Nothing in this section prevents the Coach from complying with a lawful court order or other legal obligation.
8. Mental Health, Medical, Safeguarding and Other Professional Needs
Certain circumstances may require support beyond the scope of coaching.
The Coach may recommend that the Client obtain appropriate professional support where circumstances involve, for example:
- Significant mental-health difficulties;
- Suicidal thoughts or self-harm;
- Threats of harm to another person;
- Eating disorders;
- Substance dependence;
- Domestic violence or abuse;
- Serious developmental concerns;
- Medical issues;
- Suspected abuse or neglect of a child or young person;
- Significant trauma;
- Active child-protection proceedings;
- Legal or custody disputes;
- Circumstances requiring formal educational or developmental assessment; or
Matters requiring specialist safeguarding, legal, medical or mental-health expertise.
A recommendation to obtain other professional support does not constitute a diagnosis.
The Coach may pause, decline or terminate coaching where the Coach reasonably believes that coaching is outside the Coach's scope, inappropriate for the Client's current needs, or should not continue without additional professional support.
9. Coaching Relationship
The coaching relationship begins when the Client books and pays for a coaching session and the Coach accepts the booking.
The coaching relationship is limited to the adult Client and the Coach.
No coaching relationship is created between the Coach and any child, young person, family member, colleague, student, employee, employer or other third party discussed during coaching.
The Coach may decline a booking or refuse to begin or continue coaching where the Coach reasonably believes that the service is unsuitable, outside the Coach's scope or affected by a conflict of interest.
10. Child and Vulnerable-Person Safeguarding
The safety and wellbeing of children, young people and vulnerable persons may take priority over ordinary confidentiality expectations.
If information disclosed during coaching gives the Coach reasonable grounds to believe that a child, young person or vulnerable person may be experiencing abuse, neglect, exploitation or serious harm, the Coach may take safeguarding action that the Coach reasonably believes is appropriate and which is permitted or required by applicable law.
This may include seeking professional safeguarding advice or contacting an appropriate safeguarding service, healthcare professional, emergency service, law-enforcement agency or public authority.
Clients who work professionally with children remain responsible for understanding and complying with the safeguarding policies, reporting procedures and legal or professional obligations applicable to their own role.
Legal reporting obligations differ between jurisdictions. Nothing in these Terms requires the Coach to make a disclosure where doing so would be unlawful.
11. Sessions and Delivery
Coaching sessions are provided online using the communication platform specified by the Coach or agreed with the Client.
The Client is responsible for:
- Providing accurate contact information;
- Joining the session at the agreed time;
- Having a suitable device;
- Having a reasonably reliable internet connection;
- Using a private and appropriate environment where possible; and
Taking reasonable steps to prevent unauthorised persons from hearing or accessing the session.
The Coach may use reasonable alternative communication methods if technical problems prevent the planned platform from being used.
The Coach does not guarantee that any particular platform, connection or technology will operate without interruption.
12. Session Recording
Sessions will not be recorded by the Coach unless the Client has provided prior express consent or recording is otherwise agreed in writing.
The Client must not record, reproduce, publish, distribute or share any coaching session, recording, transcript, written material or other coaching content without the Coach's prior written consent.
This restriction does not prevent the Client from making reasonable personal notes for their own use.
13. Confidentiality
The Coach will treat information shared during coaching as confidential, subject to the exceptions in these Terms and any mandatory legal obligations.
Confidentiality may not apply where:
- Disclosure is required by law, court order or a lawful request from a public authority;
- Disclosure is reasonably necessary to address a serious risk of harm;
- Disclosure is reasonably necessary for safeguarding;
- Disclosure is reasonably necessary to obtain professional, legal, accounting, insurance or technical advice;
- Disclosure is made to service providers who support the Company's business and are subject to appropriate confidentiality obligations;
- The information is already publicly available through no breach of these Terms;
- The Client has consented to the disclosure; or
Disclosure is reasonably necessary to establish, exercise or defend legal rights.
The Coach will seek to limit disclosures to information reasonably necessary for the relevant purpose where practicable.
14. Privacy and Personal Information
The Company collects and uses personal information in accordance with its Privacy Notice.
The Privacy Notice explains how personal information may be collected, used, stored, retained and disclosed in connection with coaching services and related business activities.
The Client should read the Privacy Notice before booking a coaching session.
The Client should avoid providing unnecessary sensitive information about children, young people or other third parties.
15. Intellectual Property
Unless otherwise stated, materials provided by the Coach, including worksheets, exercises, written guidance, templates, videos, audio, presentations, text, graphics and other content, belong to the Company or its licensors.
The Client receives a limited, personal, non-exclusive, non-transferable and revocable right to use such materials for their own personal or internal professional development purposes.
The Client must not, without prior written permission:
- Copy or reproduce the materials except for reasonable personal use;
- Sell, licence, publish or distribute the materials;
- Upload the materials to a public or shared platform;
- Use the materials to provide coaching, training or consultancy to others;
- Remove copyright or other proprietary notices; or
Create derivative works for commercial use.
The Client retains ownership of information and materials that the Client independently provides to the Coach.
The Client grants the Company a limited right to use Client-provided information only as reasonably necessary to provide, administer and improve the coaching service, comply with legal obligations and exercise or defend legal rights.
16. Client Conduct
The Client must communicate respectfully and must not:
- Harass, threaten, abuse or intimidate the Coach;
- Make discriminatory or hateful comments;
- Attend a session while dangerously intoxicated;
- Use coaching to obtain an assessment or statement for an improper purpose;
- Misrepresent the Coach's role, qualifications or statements;
- Share confidential coaching content without permission;
- Attempt to access another person's account or session;
- Interfere with the operation of the coaching platform; or
Use the coaching service for unlawful purposes.
The Coach may pause or terminate a session where the Client's conduct makes it unreasonable or unsafe to continue.
17. Fees and Payment
Fees are stated at the time of booking or in a separate written agreement.
Payment must be made in advance unless otherwise agreed in writing.
A booking is not confirmed until payment has been successfully received.
The Client is responsible for providing accurate payment and billing information.
The Company may use third-party payment processors. The Client may be subject to the payment processor's terms and privacy practices.
The Company is not responsible for delays caused by a bank, card issuer or payment processor.
18. Refunds and Cancellations
The Refund & Cancellation Policy forms part of these Terms.
Unless otherwise stated in that policy:
- Cancellations or rescheduling requests made at least 48 hours before the scheduled session may be eligible for rescheduling or a refund;
- Cancellations made less than 48 hours before the scheduled session are normally non-refundable;
- Missed appointments are normally non-refundable;
- Late arrival does not normally entitle the Client to a refund or additional time; and
A refund may be provided where the Coach cancels a session or is unable to provide a material part of the booked service.
Nothing in the Refund & Cancellation Policy excludes or limits any mandatory legal right that cannot lawfully be excluded.
19. Third-Party Services and Links
The coaching service may involve third-party platforms, payment processors, scheduling tools, email providers or other services.
The Company does not control third-party services and is not responsible for their availability, security, content, terms or privacy practices.
The Client is responsible for reviewing the terms and privacy notices of relevant third-party providers.
20. Availability and Changes
The Coach may change availability, session times, platforms, materials or service arrangements from time to time.
The Company will make reasonable efforts to notify Clients of material changes affecting an existing booking.
The Company may suspend or discontinue the coaching service where reasonably necessary for operational, legal, safety or business reasons.
21. No Guarantee of Results
The Client understands that coaching outcomes depend upon many factors, including the Client's circumstances, choices, actions, participation and factors outside the Coach's control.
The Coach does not promise or guarantee:
- Improvements in a Client's relationship or interactions with a child or young person;
- Changes in a child's or young person's behaviour;
- Improvements in family circumstances;
- Improvements in a professional or care environment;
- Changes in the behaviour of parents, colleagues, students or other third parties;
- Improvements in mental or emotional wellbeing;
- Achievement of a specific personal or professional goal;
- Resolution of a specific problem; or
Any other particular result.
Testimonials, examples and educational content describing other people's experiences do not constitute a promise that the Client will obtain the same result.
22. Public and Social-Media Content
General information provided by the Coach through social media, videos, websites, articles, newsletters, podcasts or other public content is provided for general educational and informational purposes.
This may include content concerning parenting, relationships with children, child-related challenges, communication, education, caregiving or working with children and young people.
Public content is not personalised coaching and does not create a Coach-Client relationship.
Public content is not medical, psychological, therapeutic, legal, safeguarding, educational-assessment or other regulated professional advice.
A coaching relationship begins only when coaching services are expressly accepted and provided under these Terms.
23. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the coaching service and related materials are provided on an “as available” basis.
The Company does not guarantee that:
- The service will be uninterrupted or error-free;
- The service will meet the Client's particular requirements;
- Any particular outcome will be achieved;
- Materials will be complete, current or suitable for every situation; or
Any third-party platform will remain available or secure.
Nothing in these Terms excludes or limits any warranty, condition, right or remedy that cannot lawfully be excluded or limited.
24. Limitation of Liability
To the maximum extent permitted by applicable law, the Company and Coach will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, business, opportunity, goodwill, data or anticipated savings arising from or connected with the coaching service.
The Company and Coach will not be responsible for loss or harm arising from:
- Decisions made by the Client;
- Actions or omissions of the Client;
- Interactions between the Client and a child, young person or other person;
- The Client's failure to obtain appropriate professional advice;
- Information provided by the Client that is incomplete or inaccurate;
- Third-party platforms, payment processors or communication services;
- Technical problems outside the Company's reasonable control; or
Events beyond the Company's reasonable control.
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence where such exclusion is unlawful;
- Fraud or fraudulent misrepresentation;
- Wilful misconduct;
- Breach of confidentiality where liability cannot lawfully be excluded;
- Any other liability that cannot lawfully be excluded or limited; or
Mandatory consumer rights.
Subject to the above, the Company's and Coach's total aggregate liability arising from a particular coaching booking will not exceed the amount paid by the Client for that booking.
25. Client Responsibility and Assumption of Responsibility
The Client voluntarily chooses to participate in coaching.
The Client remains responsible for their own:
- Decisions;
- Actions;
- Behaviour;
- Parenting or caregiving choices, where applicable;
- Professional decisions, where applicable;
- Interactions with children and young people;
- Relationships;
- Compliance with applicable workplace or professional obligations;
- Safeguarding responsibilities;
- Health and wellbeing; and
Use of information discussed during coaching.
Coaching may involve discussion of difficult, personal, professional or emotional subjects.
The Client is responsible for communicating if a particular subject, exercise or approach feels inappropriate or if the Client requires a different type of professional support.
26. Indemnity
To the maximum extent permitted by applicable law, the Client agrees to compensate the Company and Coach for reasonable losses, liabilities, costs and expenses arising from:
- The Client's breach of these Terms;
- The Client's unlawful, fraudulent or willfully wrongful conduct;
- The Client's misuse of coaching materials;
- The Client's unauthorised recording, publication or distribution of coaching content; or
Claims brought by a third party arising from the Client's actions.
This section does not require the Client to compensate the Company or Coach for losses caused by the Company's or Coach's own negligence, fraud, willful misconduct or breach of a non-excludable legal obligation.
27. Termination
The Client may stop participating in coaching at any time, subject to the Refund & Cancellation Policy.
The Coach may suspend or terminate the coaching relationship where:
- The Client breaches these Terms;
- The Client fails to pay;
- The Client behaves abusively, threateningly or unlawfully;
- Coaching is outside the Coach's scope;
- The Coach reasonably believes that coaching is unsuitable or unsafe;
- A conflict of interest arises;
- Continuing would create a safeguarding, legal or professional concern; or
Termination is otherwise reasonably necessary.
Termination does not affect rights or obligations that arose before termination.
Sections concerning confidentiality, privacy, intellectual property, disclaimers, liability, indemnity, governing law and dispute resolution will continue to apply after termination where appropriate.
28. Complaints
The Client should first raise any concern with the Coach by emailing:
emilieolsencoach@gmail.com
The Client should provide sufficient information to allow the concern to be investigated.
The Company will review complaints fairly and within a reasonable period.
Nothing in this section prevents the Client from contacting a relevant regulator, consumer-protection authority or other public body.
29. Governing Law and Jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region.
Subject to any mandatory consumer rights, the courts of Hong Kong will have exclusive jurisdiction over disputes arising from or connected with these Terms or the coaching service.
If the Client is legally entitled to bring proceedings in another jurisdiction, nothing in this section removes that mandatory right.
30. General Provisions
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or removed only to the extent necessary, and the remaining provisions will continue in effect.
A failure or delay in enforcing a right does not waive that right.
The Client may not transfer or assign their rights or obligations under these Terms without the Company's prior written consent.
The Company may transfer or assign its rights and obligations as part of a business transfer, restructuring, merger, sale or other corporate transaction.
These Terms, together with the Privacy Notice and Refund & Cancellation Policy, form the entire agreement between the Client and the Company concerning the coaching service, unless a separate written agreement expressly applies.
No person other than the Client, Company and Coach has rights under these Terms unless applicable law provides otherwise.
